No? Make it the default, but with an option to sign away the right. If a father refuses the test, then he remains legally responsible for the kid despite any later evidence that it's not his. Most will take the test at birth to avoid the lock-in.

Somehow got the wife to agree to DNA testing and despite it being in our birth plan the nurses tried talking us out of it when we got to the hospital and was going over what the next couple of days were going to be, was told they tried again anytime I was out of the room and just a general refusal to do it till we were checking out 2 days later.
