It's pretty telling that the Selective Service still has not submitted an NPRM to the OIRA as the 30 day deadline approaches. The public comment period can take 30 - 60 days by itself but the OIRA review period of 30 days is much more strict and the SS still refuses to submit an NPRM with only two weeks left until the 30 day deadline passes.

Realistically courts would just issue an injunction saying that the failure to publish and implement a rule violated the duty of notice to the public in (iirc) the Administrative Procedures Act, and so implementation of any rule was invalid until that process had been followed.
