I'm not familiar enough to talk much about TM laws and what not, but considering it was up on the site I'm sure it was done properly and legally. I'm sure there's some strange nuances, but the thing is no one actually owns these, so who could even challenge it? If anything a challenge would arise if some other company than the TM holder would make a Tung or whatever else and the holder were to claim and infringement.
