although Nintendo do have a legal obligation to repair or replace drifting Joycons, the argument the French courts used is faulty. calling it a "misleading business practise" implies Nintendo deliberately made Joycons that would drift, so all Nintendo would have to do to get the ruling overturned is argue that they did not intend for them to be faulty. which would be a pretty watertight argument. and it would then allow Nintendo to skirt ever having to pay for the repairs because of double jeopardy.
I dunno if Euros have them but in America we have Lemon Laws specifically to go after companies that let faulty goods enter the market.

Wrong. The misleading business practice is in continuing to sell the Switch with the malfunctioning Joycon sticks, when they were already aware - and had been aware for multiple years - that the actual mechanical design of the sticks was flawed and this was a factory defect and thus a product unfit for sale. You are not allowed to sell products in the EU that you KNOW are defective. Period.
