The misleading business practice is in continuing to sell the Switch with the malfunctioning Joycon sticks, when they were already aware - and had been aware for multiple years - that the actual mechanical design of the sticks was flawed and this was a factory defect and thus a product unfit for sale. You are not allowed to sell products in the EU that you KNOW are defective. Period.
