According to intellectual property expert Florian Mueller, Nintendo can no longer prevent the release or sale of the current versions of Palworld. After the lawsuit was initiated, Pocketpair altered numerous game mechanics to circumvent the patents in dispute, and Mueller states that he sees no path for Nintendo to obtain an injunction with real impact on the recent versions of the game or on the launch of version 1.0, scheduled for July 10.

>According to his analysis, the dispute would now be restricted to older versions of Palworld. Even in a scenario favorable to Nintendo, the maximum compensation would be around US$30,000, since the patents in question only became valid after the game's release, limiting the period in which damages could be claimed. This would mean that the case has ceased to represent a significant commercial threat to Pocketpair.

They definitely spent more on the lawyers alone. So even with the fucking planets aligning to make the best case scenario for Nintendo, they're out money, several patients and the lack of scrutiny that got them the patients in the first place.
>>
>Nintendo lost because they got exactly what they wanted out of the lawsuit
???
>>
>>741033281
they didn't though, they wanted an injuction to make palworld disappear and some change
that will no longer happen and if they win they will get less money than they wanted at first
>>
In my college patent class I was told that if you file a patent but someone proves that the solution was already commercially available prior to your filing/publishing, you can go kick rocks.
What exactly was the case that Nintendo had here?

Their case was Japan is filled with retards willing to do what they want
>>
>>741033452
iirc the biggest one was capturing and releasing digital animals in spheres or something to that affect
they tried to throw other patents like running around in a digital environment or jumping in a digital environment, retarded innocuous shit that no court would ever care about so that's why their losing so hard at their attempts at patent trolling

They wanted to block sales of the game going forward and this resulted in a maginfying glass being put on them and their patients in both the US and Japan. The investigations the US and Japanese patient offices resulted in the revocation of several patients and more scrutiny on anything they submit going forward. Even if they win here: it's pyrrhic.
Hope this helps.

Nintendo should have sued them instead for infringing on their "patented" slop peddling strategy.
>>
>>741033607
Yea I remember that.
The way patents were explained to me (europoor) is that they work like this
>Company N makes a game where you stuff animals into balls
>Company P makes a game inspired by the one Company N made that also has balls you can stuff animals in
>Company N files for patent for stuffing animals into balls
>Company N: "HEY, Company P is breaking our patent! We are suing"
>Court: "The patent says that it was filed after company P made it's game. You also did not patent this before releasing your original game way back when, so this patent is null and void"
In some of those earlier threads it was explained that is not how it works in Japan, some Zaibatsu shit like other anons pointed out >>741033564, >>741033720, >>741033970

Throwing a ball to release a creature. Now Palworld has you hold the ball when the creature is released.
That's it. That's what this multi-year drama was all about.

So yeah, go nintendo, get fucked palworld, I guess.

Didn't they show ball throwing in the 1.0 trailer? It made it look like all the revisions are getting changed back.
>>
>>741036513
they were changed to ease the laswsuit but for ball throwing specifically, nintendo ended up losing the patent, so they probably added it back. As for gliding, I don't know how that ended up or if it's getting reversed.

Nintendo wanted Palworld to stop being sold. They only were ever asking for a pittance of money in the settlement because you have to put SOMETHING there for damages for a suit to be filed in the first place. You can't be made whole, if you can't prove you have been damaged.
Palworld isn't getting stopped. They'll, at best, get the pittance they asked for, which was only a formality, that represents significantly less than they spent on the case to begin with.
Realistically, the legal team at Nintendo have caused more in assorted damages to Nintendo than Palworld itself ever would have if left unchecked, lmao
Respect where it's due. The Nintendo legal team certainly knows how to pull the levers on the endless gravy train while making their boss look stupid.

Not necessarily
I can claim that, I dunno, you have infringed on my fishing minigame patent with your forging minigame. They're actually nothing alike, my fishing mini game is a "keep the bar in the center" game, your forging minigame is a rhythm game.
Assuming the lawsuit is accepted in the first place, your forging minigame is under question regardless of how likely it is to hold up, so it is in your best interest to remove it for at least until the case is wrapping up. Leaving it in can be seen as contempt among other things, and removing it isn't inherently an admission that your forging game is like my fishing one.

Put it this way. If the police arrest you, for standing on a street corner in a rabbit suit, claiming that you were trying to sell drugs, if you post bail, it would be in your best interest to not continue to wear the rabbit suit and stand on the street corner until your trial date comes up, even if you really aren't selling drugs, you're just advertising your rabbit pelt business, or just are really into rabbit suits. Not wearing the suit isn't an admission that you were selling drugs in a rabbit suit, it's just avoiding potential further infractions, legitimate or otherwise, until we can all agree that you being in a rabbit suit on the corner is fine.

Pocketpair is already developing Palfarm and the VN while working on Palworld.
>>
>>741033281
The only thing they accomplished was forcing Pocketpair to make some changes that are basically whatever
>can't use certain pals as gliders anymore which is fucking whatever because you've got pals that can fly
>summoned pals appear next to you instead of being summoned by throwing a palsphere which is pretty minor
Nintendo was aiming to kill the game altogether or at the very least get them to remove the ability to capture pals and ride on pals which probably would have actually been successful in terms of killing it since that'd reduce it to a generic survival crafting game. They ultimately lost and they lost hard
>>
>>741033281

>>
>>741040195
>>summoned pals appear next to you instead of being summoned by throwing a palsphere which is pretty minor
This one sucks because it was fun throwing a pal into a camp like a grenade and just letting them go to town.

Also the game has mod support so I'd imagine it's only a matter of time until someone makes mods that add those missing features back in so Jewtendo kind of failed in that regard as well.

They're telling themselves that Nintendo achieved everything they wanted with the lawsuit. Apparently it was all about that 30k and a handful of patents for very, very specific features, all conspicuously filed after Palworld was announced. It comes across less like they thought the few specific changes they made killed the appeal of Palworld and more like they think they're enough of the appeal of Pokemon that any other game having them is a threat.

The injunction was only one the mechanics which have been removed completely from the 1.0 version which is why it isn't included in the lawsuit, not by Nintendo's own choice to exclude it.

>and if they win they will get less money
No? If they win they get 30k each plus damages which is what they sued for in the first place.
>>
>>741040596
>Apparently it was all about that 30k and a handful of patents for very, very specific features, all conspicuously filed after Palworld was announced
That is what it was about, they sued them for patents that they had filed for several year before Palworld released.

>It comes across less like they thought the few specific changes they made killed the appeal of Palworld and more like they think they're enough of the appeal of Pokemon that any other game having them is a threat.
Not really, I mean, going by the pitiful amount that they sued for in the first place it clearly wasn't for the money nor was it about how "harmful" it was. It was clearly about maintaining some integrity in the industry where creators are concerned.

That's right, daddy Nintendo always meant to sue over a pathetically tiny amount of money and a few hyper specific mechanics. You can tell because that's what they're managing to get through after all this time in court. Nintendo has achieved all of its goals. Nintendo has won. Because Nintendo could NEVER lose.
>it clearly wasn't for the money nor was it about how "harmful" it was
It was about trying to squash the competition without offering a better product, that's correct.
>It was clearly about maintaining some integrity in the industry where creators are concerned.
"Integrity" my fucking ass. Nintendo settled for these tiny ultra specific mechanics because they couldn't sue Palworld into shutting down.
