It's functionally a CD key on a physical object that phones their servers to download the game. On Nintendo's side this goes one step further where if your system or account are banned it can't even obtain the game since it can't connect to the eShop at all whereas I believe on at least a Playstation system it will still grab it since it's through their patch servers essentially. I think Playstation needs a full system ban (Which they almost never do compared to Nintendo, but even Nintendo only does this for hackers really) in order to restrict that.To anyone who cares about this it's a world of difference because you don't own the latter due to being beholden to the company to get it at all in any way while the former you truly own it as they can't stop you from installing it since it's on the disk itself.
