It's functionally a CD key on a physical object that phones their servers to download the game. On Nintendo's side this goes one step further where if your system or account are banned it can't even obtain the game since it can't connect to the eShop at all whereas I believe on at least a Playstation system it will still grab it since it's through their patch servers essentially.
