I agree with both of these, but I actually think implementing the first one is likely to be far harder. You have to remember, freedom of speech and freedom of religion as understood in the modern west were created by Christians who all actually believed heresy was literally a deadly sin, in the aftermath of the Thirty Years War and other similar conflicts. Belief that something is immoral does not prevent people from believing that legally prohibiting it is wrong.

In contrast, I think many governments would be reluctant to impose the regulation required in #1 because it would damage their country's economy to restrict multinational corporations in this way when other countries aren't also doing it. Introducing these regulations when they aren't seen as the norm would just cause businesses to abandon their markets.

The people in charge of this don't care about any notion of "age-appropriateness", to them the content is objectionable in and of itself and games will get censored or banned if they trip specific flags decided by the platform holders themselves regardless of whether they're E-rated or M-rated or even CERO Z. Anyway, I'm struggling with how to express my thoughts, so I made a timeline of events of Sony Interactive Entertainment's censorship.
- UK has Anti-Fiction laws criminalizing pornographic lolisho.
- Ecchi games with lolis release in the UK per PEGI and the UK's Video Games Council. Ecchi games with lolis release in in countries that criminalize lolisho, but it is entirely legal because ecchi isn't pornography
- Suddenly, the UK's Video Standards Council decides Omega Labyrinth Z is bad for kids despite its PEGI 18 rating. They ban PQube's release/localization. The game is still legal to import.
- Sony's PlayStation divison has been HQ'd in America since 2016. Sony banned Super Seducer days prior to the UK banning Omega Labyrinth Z. (Fun fact: The 3rd game got banned by Steam years later, depsite previous games' release on Steam without censorship.)
- After a few months of Omega Labyrinth Z's ban by the UK, Sony decides to ban PQube's release/localization of Omega Labyrinth Z in all regions.
- Sony establishes stricter restrictions on fictional expression. All Japanese games now have to go through a censorious approval process in English and during the Western hours by Sony Interactive Entertainment. (Note: Sony's Anti-Fiction restrictions are likely still in effect to this day. The chilling effects are everywhere, and the censorship is invisible because of compliance in advance by publishers. For a 2025 example of Sony censorship, see attached.)
- Games that were censored by Sony were uncensored on other platforms. The Video Games Council even approves of these PEGI-rated, uncensored versions.
- The Wall Street Journal investigates this situation. Sony cites #MeToo and video game streaming.

When it comes to any kind of clawing back to an earlier or more relaxed standard you start running in to numerous problems.

Western countries have made it 100% clear anyone appearing in sexual material needs to be 18+ and the rules for real people were put in place in 1984 for the US/Hollywood. Many moral panics and controversies happened in various media that created a much more hostile enviornment over anything sexual while violence slipped through.

Japan on the other hand had a culture that was a bit more lax in enforcing rules on what was considered sexual (innocent nudity, nudity as a joke, peeking up panties being an embarassing thing, any kind of sexual harassment being called teasing) and pretty much allow it to happen to Junior High students upwards. They're not going to budge on that part and every Japanese production about stuff happening to you the player (who is in high school) where your classmates and little sister start doing sexual stuff is going to have trouble coming out.

There was so many incentives for Sony. There were external and internal pressures. The Japanese tend to blame global audiences and modern audiences, but I believe that's too imprecise and defeatist. I believe the core cause is the existence of subversive forces within fiction communities and fiction-producing companies. Their goal is simply to censor fictional expression. I think the difference is that the United States protects speech while Japan protects expression.
Because Japan's analysis is through the lens of expression, it's obscenity laws are enforced against expressions (something that is seen) like genitalia. Meanwhile, America's censorship targets themes (something that is conveyed through language). Does this make sense? It's something I've only recently started thinking about.

Incidentally, America has a history of Anti-Fiction restrictions like the Comic Code Authority and the Hays Code. I also think someone like Anita Sarkeesian has a lot of parallels to Fredric Wertham because they were both Anti-Fiction activists.

Companies and games were already acknowledging this by removing the ages from Senran Kagura games and aging up lolis to adults in western releases.
It wasn't enough and eventually they started attacking the games based on some retarded notions of consent (how the fuck do you judge whether a fictional character is consenting) and body type/head shape to determine underage basically declaring the whole art style to be inherently pedophilic.
Point being, some compromises WERE made without seriously affecting the integrity of the works and they weren't enough. An inch was given and they took a mile.
