The consumer complaint against Valve is that it gave malware a platform and legitimacy by hosting it on Steam.
Steam being a platform that controls uploads and downloads through its proprietary system adds more capability.
It'd require a deep-dive into the Steam ToS which I can't be assed to do, but the primary suit would depend on a few things.
1) Whether Steam shoots itself in the foot in the ToS and makes any claims that they actually monitor uploads for malware (which hits a limit on freedom from liability as that's considered lawfully promising to take responsibility for uploads)
2) Whether this malware was pushed through forced updates on games/mods to which the user did not consent to have the damaging product installed
3) The scope of their negligence. A few cases slipping though the cracks would not legally be seen as a violation
4) How the courts choose to interpret malware. In the previous cases, the only time malware has invoked S230 was when the computer service removed malicious content despite monetary compensation, which S230 protects the service providers on under the interpretation that malware can be classified as "otherwise objectionable content". However, there has yet to be a case where the users of a service have sued the service for inflicting them with malware. This would likely reopen the term "otherwise objectionable content", that is currently seen as Valve's defense, to reinterpretation.
If the lawyers can make a case with the above and encourage a higher circuit to reinterpret that term, then I'd say there could be a real case here.
Not that I care whether Valve gets reamed or not, but S230 is a fucking mess of loose terminology and likely won't survive the next decade anyway. God fucking help the internet if that thing goes sideways. What protects them, protects us, and protects this site. If its seen as too outdated because of cases like this and gets rewritten, we're all fucked.
