Pokémon is being sued in a class-action lawsuit after a former engineering director allegedly tried to get a "Peek-achu" at women and children while they were undressing in the bathroom.

A woman -- who filed the lawsuit as Jane Doe -- is accusing The Pokémon Co. International Inc. of failing to protect employees and visitors at the company's Bellevue, Washington, office from former director of engineering, Ben Tsai.

Tsai was arrested last month and charged with first-degree dealing in depictions of a minor engaged in sexually explicit conduct, first-degree possession of those depictions, first-degree voyeurism, and second-degree possession of depictions of a minor engaged in sexually explicit conduct.

Cops say they found hundreds of videos from the bathroom at Pokémon's office as well as recordings allegedly taken in a local Starbucks restroom and videos taken from inside the bathroom in Tsai's own home.

Jane Doe -- who says she worked for the company for five years -- seeks to represent people who used the company's bathroom between 2017 and July 25, 2026.

The lawsuit alleges Pokémon failed to adequately supervise Tsai or address the signs of his alleged illicit behavior.

Bradley G. Barshis -- the lawyer representing Tsai in the criminal case -- told Law360 Monday that Tsai "has entered and will enter pleas of not guilty to all charges, meaning he is presumed innocent throughout these cases, and unless things should change, we have no further comment."

A Pokémon spokesperson tells TMZ ... "Our focus remains on the well-being of our employees. We are unable to comment further on pending litigation."

>Tsai reportedly told detectives he was “mainly curious about transgender people” and acknowledged that transgender employees worked at the Pokémon office where he allegedly hid a camera.

>A forensic review of devices seized from Tsai’s home reportedly uncovered hundreds of hidden-camera recordings. Investigators found 89 videos allegedly filmed in Pokemon office bathrooms inside folders labeled “Pokémon 29” and “Pokémon 27.”

The lawsuit was filed by an anonymous plaintiff in King County Superior Court last week. It alleges that Ben Tsai, former director of engineering at the U.S. headquarters of The Pokémon Company International in Bellevue, placed and used cameras to record video and images of children, employees and members of the public at “various states of undress while they used the restroom.”

They confirmed that Tsai, 45, was no longer an employee as of January.

According to the criminal charges, an investigation led by the Kirkland Police Department discovered that Tsai possessed hundreds of videos depicting adult nudity and child sexual abuse material, some of which were recorded by Tsai.

The videos he recorded were from the Pokémon offices in Bellevue, the Starbucks bathroom in Kirkland, a Safeway store and his home, according to the charges.
“Seeing someone who is engaged in the extensive amount of voyeurism and conduct that he’s been charged with, the idea that this was all just for his own personal use and that there was no distribution seems doubtful,” said Alex Dietz, one of the plaintiff’s attorneys in the civil lawsuit.

The suit seeks a class-action status to represent all women and girls who used the bathroom facilities at the Bellevue office from 2017 through July 25, 2026.

Even though Tsai’s employment with Pokémon ended, the attorneys used July 25 to set the time period for the lawsuit to “ensure that we captured any possible time frame where he may have entered the building,” Dietz said.

The suit also alleges that The Pokémon Company was negligent in failing to properly train Tsai, to make reasonable efforts to control his actions or to protect the plaintiff from harm by responding to indicators of danger.

The company needs “to take steps to protect kids from these known risks,” Dietz said.

There is no negligence, you can't stop something that's happening secretly until you know about it.
And given that they were in bathrooms to begin with the only way you could feasibly do that would be to add cameras to the bathrooms which defeats the purpose because you're just doing the same thing he did.

MJ and Sony did not get along, and in general MJ is still super popular and any documentary about him makes money. I mean the film about his life was a huge success.

The very first family that sued him was caught on tape literally, LITERALLY admitting it was just about money. The father said "He will pay us, or we will ruin him." MJ wanted to fight the case, but his legal team basically say:
>MJ, you're on a billion dollar world tour will sellout concerts in Japan. Just settle, this is literally a drop in the bucket. If you go to court now you have to cancel the entire tour
So he settled. It then opened him up to more suits because he was known as a "settler". He regretted the decision and said he wish he cancelled very concert if it meant defending himself. That is why when the second allegations came out he fought time in court and WON and it was not even remotely close. Frankly, the other side had a pretty poor case that was demolished by MJ's legal team.

So yes. Also, the guy LITERALLY wrote a song in which he said:
>Jew me, sue me, you can never do me
>Kick me, kike me, don't you black and white me
That probably made some lawyers and execs pretty mad. He had to go back and censor the song later and "apologize" for it.

Because it was discovered that the company as a whole did it that way. It wasn't just one individual instance of hot coffee.
That said that particular case should have been a win for McDonalds regardless because it was obviously consumer negligence since she squeezed the coffee between her thighs.

It was also company negligence to not do regular checkups of their ceilings. >Someone trespassing doesn't mean you're allowed to do anything you want to them nor is it their fault for getting hurt by a pitfall
Yes, yes it is.
If you tresspass on to someone else's property and injure yourself in a way that was not caused by the owner of the land ie your own negligence, you aren't going to be able to sue anyone.
>Booby traps in particular are extremely illegal but that's kind of a different discussion.

So you're saying that the man in question went into the women's restroom at least twice a day over the course of multiple years and no one saw him once? You realize there ARE cameras outside of the bathrooms so you can see who goes into them, correct? In your scenario, it's even worse lol.

On the contrary, depending on the age of the building they might not even have clearance to do a thorough search due to the possibility of it containing things like asbestos, health and safety and all.
And again, even if they could why do you think the cameras would still be there?
>You are supposed to do maintenance for ceiling air handlers, bathroom fans, air filters, and do inspections for potential mold growth due to humidity.
Maintenance and inspections occur usually every 6 months to a year depending, it's not a daily thing like you seem to think.
>The fact that this individual has so much footage makes negligence a stronger case.
No, no it isn't. The main reason being the individual comitting the act secretly. Also being a higher up he would also be aware of any potential checks and know when to move his devices.
The only way it could be considered negligence is if he went around advertising it to the staff and they let him.

No, anything can be considered dangerous, people sell knives, guns etc that can cause self harm, if someone harms themselves with it then you don't get to sue for your own actions, that shouldn't be any different.
You're basically using the same logic as politicians who want to implement online IDs using "the children" as an excuse.

>>
>>744728949
>it's done slowly through the 6-12 months so as to make it a constant job
For different things, yes.
Bathroom maintenance is going to be 1 to 3 days depending on if there's an issue or not. It's not a long time. Most of the red tape for that has to do with environmental problems and potential biohazards.
As a personal anecdote when I was a teen working retail one of our escalators was shut down because because an old man had fallen down it and bled all the way down. We couldn't turn it back on until it had been safety checked but it couldn't be checked because the man on maintenance deemed it a biohazard and wouldn't touch it until it was deep cleaned something we didn't have the tools to deal with. So despite any surface blood being gone it was out for months but I digress.
>Because entering a woman bathroom twice a day for years should also raise some red flags?

There is a legal concept called "duty of care". It basically means that if you have a company, it's the company's responsibility to ensure that no unlawful or tortious activities are going on within, you don't get to just say "well I didn't know that my employees were illegally dumping toxic byproducts from our factory in the water" because then you could order employees to do that, bribe them to accept a few years in prison, and just get away with it. Likewise you can't just have a pervert putting cameras in the bathroom because it was tue company's job to prevent things like that going on.
>>
>>744731624

If its found that the company neglected their responsibility in investigating a claim, or otherwise caused harm through willful negligence or by not taking actions that would be considered standard expectations, then by all means suing the company is the right call.
A company is not at fault for the actions of an individual employee unless their own processes failed to protect others.
You cant investigate an action until it becomes known.

And most of the complaints people have about the trial is that if it only resulted in one victim in many decades it's not extreme level of negligence.
Yes anon the coffee temp needed to go down. Yes, MCd should cover the medical bills. No, a one in a billion customer drawing the short straw after 50 years of selling lava is not negligence.
>>
>>744732203
Duty of care pertains predominantly to repair outside of the hospitality and nursing sectors you idiot.
>you don't get to just say "well I didn't know that my employees were illegally dumping toxic byproducts from our factory in the water"
Different matter entirely relating to disposal of substances created by the company, toxic waste products need to be logged and sent to the appropriate facility.
We're talking about one person making secret recordings by himself, for himself. The company would not be liable for that and preventing it would require far more invasive checks to prevent that would have to apply to every employee.
>>
>>744732736
>No, a one in a billion customer drawing the short straw after 50 years of selling lava is not negligence.
NTA but over 700 complaints/settlements about the hot coffee that were filed before that suit that became national news. It was absolutely negligence in assuming that people were smart enough to let their coffee cool down before drinking it.

I have a feeling that people in these companies (women) are trying to take advantage in a lull in popularity than make these kinds of accusations to siphon money from the companies.
Remember California admitted that Blizzard did nothing in court documents and still fined them 18m and forced them to hire more women because they were "harassing" women.
Just fire the person if they actually set up cameras, and look deeply into the accuser's life to see if they were actually affected or if they just made it up.
Don't pay out any settlements and put out a good game as soon as possible to make this shit go away.
People now-a-days are trying to milk these companies for money over bullshit accusations and destroy gaming.

in america now, the parents get charged with a crime because it happened due to their negligence. the parents don't get charged for shooting up the school, they get charged for giving the kid access to the gun.

tpc isn't going to get charged for the videos, they are being sued for being responsible for the circumstances that allowed it to happen.
>>
>>744738083

You don't understand anon. This is more akin to suing the store that sold the gun for the act of the act of the school shooting because he should have known it was going to be used for a school shooting before selling.
In other words they're trying to sue for the act, pushing the crime on to the company rather than the perpetrator.

Except that's not what's happening. In this case you could claim negligence because they're giving a kid access to a gun. In the case of the recordings because it was an individual acting on their own you can only sue for the recordings occurring, they didn't enable him or turn a blind eye.

But TPC is also at fault? The woman is free to start as many lawsuits as she wants, and TPC is free to also sue the dude.
You can sue anyone at fault you want, you don't necessarily have to go after everyone, whether you like it or not.
If you wanna get into the argument of whether or not it is slimy to do this this way, yeah. But it's legal.
And you also have to remember that even if you are 1000% sure you can win a lawsuit, they are extremely annoying, stressful and expensive in burgerland, and going against a random dude might not get you back the trial fees you incurred. But that's an issue with the US judicial system.

>Unless you can confirm that they knew and turned a blind eye TPCi can't be at fault
That's for the judge to decide, and yeah she might get fucked for generations for this, but there is apparently enough possibility of TPC fault to at least start the trial.
I am not giving the woman a 100% win chance, just saying that she is not in any way wrong in doing things this way.
>>
>>744738832
>TPC is also at fault?
How can they possibly be at fault anon? They were hidden recordings, they don't have future sight you know, they can't tell who's going to do what and they're not expected to play babysitter for every single employee especially not for one in a fairly high position.
If she wants to sue them she can it she's just going to be burning money when
>what exactly do you expect us to do? Pat down everyone and search every bag as employees come in and have a dedicated bathroom steward on every floor? That's a gross violation of the rights to privacy of all of our employees
Is used as a valid argument and shuts down the entire lawsuit.

You guys can argue semantics but I doubt TPC will want to have this drag out in court because "Pokemon company executive secretly filmed kids in the company bathroom" is such a heinous headline that they'll pay to not have that be in the news cycle for a year. Why don't Nintendo and Creatures team up and kick Game Freak out of the Pokémon franchise?
It's obvious that they are a terrible studio.

Town reasons.
One, that's not how it works, they would need them to sell their share and given how they literally have nothing without pokemon they're not going to do that.
Two, no company on the planet is insane enough to put in the amount of work required for a pokemon game. If they change developer there's going to be a massive quality drop more so than pokemon only players believe there has been. New mon will drop to 20 to 30 per game, they'll make the games digimon story levels of linear, maybe only have about 280 unique pokemon and the regional forms are now complete recolors like She Slime and Black Wargreymon.
Might get a graphical bump though so casuals wouldn't complain at least.

If it's an employee acting on their own then it's not a matter of negligence and there's no realistic way to stop it even if the place is filled to the gills with cameras.

>>744748990
This is something entirely different because it IS negligence. If I remember right they were told repeatedly that she had an allergy but still made it with peanut based substances or around them.
>>744749042
You people really don't understand these things. You're just saying whatever comes to mind that you think might be valid.
Anyway, not all professions even do background checks and that's mainly for the company and employee rather than the employee and what they're doing of their own volition. Even then, they aren't technically allowed to discriminate based on past actions and what not. It also wouldn't tell you about crimes that weren't caught or that they haven't done yet, obviously.

>>744749170
Which is false, a company isn't expected to babysit each and every employee. Being on company grounds is also irrelevant, by that logic you would sue the school that was shot up by a student.

No, but they are responsible for the safety of every employee while at work. OSHA covers this.
Freedom from sexual harassment is part of that safety.
> by that logic you would sue the school that was shot up by a student.
You can, if it is proven that the school did not have safety measures in place to prevent this.
>>
>>744749695
>This is something entirely different because it IS negligence.
both are negligence.

>If you think that's ludicrous it's the same situation here.
after cho shot up vtech, the state paid an $11 million settlement to most of the victims' families. so yes, schools DO pay out families whose kids get killed. this happens all the time btw, way to kill your own argument.

That's not what OSHA is for at all. That's for the actual condition of the workplace as in the actual physical area. Having fire exits free and accessible, making sure the area is hazard free, making sure the air quality is good, doing risk assessments blah, blah, blah. It doesn't cover the actions of an individual.
It's like you haven't worked a day in your life.

>You can
You can try but it won't go anywhere and the public will probably deem you a monster.

>>744750015
>both are negligence
You can't be negligent about an issue you didn't know existed you can only act once that issue has come to light and from that point on doing nothing would be negligent bu they clearly immediately fired the guy and barred him from the area making it the opposite of negligence since they acted accordingly.

>the state paid an $11 million settlement to most of the victims' families
Anon, you are aware that they tried to sue based on the university not warning someone and the case was going absolutely nowhere because there was a precedent set in another case where it was ruled a defendant couldn't be prosecuted based on the actions of a third party and aren't obligated to warn them, right?
It ultimately resulted in a settlement of 11m because they were just burning their own money out of a twisted sense of justice. It didn't come from the school and they lost of their right to sue the school.
>>
>>744750171

>It ultimately resulted in a settlement of 11m because they were just burning their own money out of a twisted sense of justice. It didn't come from the school and they lost of their right to sue the school.
no, they got the settlement right away. the lawsuit against the school was from 2 holdouts who wanted more $ and then lost.

>You can't be negligent about an issue you didn't know existed
if a roller coaster derails you can't claim you didn't know about the issue, it was your job to do the maintenance and ensure it didn't come off the rails. stop defending corporations being neglectful.
