Art stuff rarely gets to court and will usually be resolved between the two parties on undisclosed terms if it looks like there's actually something going on. And proving plagiarism either way is difficult at the best of times.
Code is patented and the company lawyers will get involved well before a single engineer even knows there's a potential lawsuit going on. And it's not just exact copy-pasted code either, broadly similar ideas can be patented even. An example is the stencil shadowing in Doom 3 which had to be ripped out of the open source release due to it being patented.
