As it is you can trade on SWSH between emulators and a Switch 1 even without a hacked Switch last I checked due to how the local trading works.As far as I understand it the bans on the Switch 1 happen because they check boot sequences, what programs are run while you have it on, and many other little things and then phone home. That's why an untouched SysNAND is fine but the EmuNAND has to be permanently kept offline.It's also clearly more involved than the 3DS and requires you to tick certain boxes on the system itself because on my Nintendo account I have my physical PAL copy of Rhythm Paradise Megamix being played on my US 3DS and system and have never been banned even when I linked it to my Switch and didn't realize they logged stuff like that.
