Like when El Dewrito ripped Halo Online, they never actually C&D'd the project. They just asked them to stop work on it and help with MCC instead (which many of its devs did, even though GameCheat tries to lie and say they didn't). Hell, El Dewrito came back and has mods for it that port all of Halo 3 and ODST's campaigns into it, and it still hasn't really been slapped.
