They ruined a man's life for hacking Switches years ago. We can do that to anons now if we stay vigilant and report everyone bragging about it online.

Unfortunately
The issue now is people used AI tools to do it, and would not have been able to without those tools.
If a person is to be held accountable for their use of AI, that implies they own the instance, the legal fruit of that AI belongs to the instance user. This is obviously not the case, and given the current hoo ha over ownership of digital content, would be an argument nobody would allow to happen, because of where it would lead.
Thus, the onus falls to the owner of that AI to put in proper safeguards, which they will not/can not do, and legally, in the US at least, you cannot pass or enforce legislation against the free use of AI anyways, until such time as the 20 year free pass is revoked.

In other words.
Nintendo can get fucked, because while the US government may hold contempt for its own citizens, and would be willing to sell them out in a heartbeat for comically small gains, this particular selling out would also mean shanking AI in the kidney, which would kill the US economy on the spot.
