Or the raid has lots of fire damage so you go for the set with extra fire resist to tank it, things like that. People will always try to find the best, so what you need to do is make lots of different set bonuses so there would end up being five or six different side grades with maybe a 3% difference. Let the sweats keep their ultimate BiS while the stuff that is really good but not quite as strong would be more accessible. Would also help during the situations like "I ran UBRS 40 times and didn't get my drop, but this set I did get from SFK60 is good enough to get me started."

If they want people to play long term give them more things to farm for. Level 60 version of some of the leveling dungeons is a relatively painless way to make the content and they already have some of the drops they can update while adding some new ones exclusive to the 60 version. And it would take some sting out of running tier .5 and getting passed over or not getting the drop for weeks on end, you could do some updated 60 dungeons to get a good sidegrade so you're still feeling like you're progressing until your pre-raid BiS drops for you.

Secondly, they also said the downranking proc nerfs (for talents) only kicked in if you downranked a certain amount of levels. So you could use a rank lower and be fine.
