I really want to know the actual legal ins and outs of downloading old ROMs. I just got baptized, so I can't commit unjustified crimes. What are the loopholes? What's the cheapest way to stay legal?
It's illegal and you already knew that.No one cares. The law does not matter in moral pursuits. The people who made the games 30 years ago don't get money if you buy used, or even if you buy the official "new" emulated versions on new consoles.

They are a net positive because a lot of games would already be lost if people didn't keep copying roms. And yes also in most cases the people who made the games don't get money if you buy used or gay re-releases/ports.
