Other dev teams have used id Tech 4. The stencil shadows technique wasn't patented by id Software: it was Creative's. id got a license for Doom 3 in exchange for EAX audio support. You're free to use the open-sourced id Tech 4 (GPLv3), but you must implement your own shadow solution to avoid any lingering issues, and anything you add on top has to be open-sourced too.
The real move is getting a proper commercial license like Infinity Ward or Valve did back in the day, so you can keep your upgrades proprietary. These days id won't license the newer engines to outsiders unless Zenimax pushes it; like how Arkane did Void Engine or MachineGames built Motor.
As of today, the latest notable id Tech 4-based release is a 2025 indie game by Blendo games.

Carmack found the method for shadowing but then found creative already held a patent. Doom 3's EAX support is probably worth it imo, I remember kids in my highschool of the day gushing about the sounds.

The source code released later just uses a different method avoiding the patent for shadows. It was released with GPL compliant shadows.
Patent is expired now either way.
