He had ample reason to arrest Light almost from the beginning but instead he kept giving him handicaps (like directly involving him in the investigation) and refusing to arrest because he was "only 99% certain". People irl get death sentences for much less certainty than that. He's basically a shinigami himself, doing what he does just because it tickles his own pickle.
