The question of which brother is who, which is supported only by biased and unreliable testimony anyway, is totally irrelevant. The estate and the title of earl never passed from Vincent to R!Ciel. Both sons were missing and presumed dead so the crown repossessed everything. And by the time O!Ciel resurfaced, R!Ciel was dead, as confirmed by public testimony from the undertaker himself. So he would have been ineligible to inherit. O!Ciel was then awarded his title and lands back by the queen. O!Ciel's only legally dubious action would be his taking of a new name without going through whatever process existed for that in 1880s England. Lizzie could use that to nullify their engagement. But it would have no effect on the legitimacy of his title. As for the cult, the only evidence connecting it to O!Ciel is testimony from a serial killer conman and the blood found at the manor. But the other most likely suspect is acknowledged by everyone to have arrived there before O!Ciel and, unlike R!Ciel's unproven accusations of stolen identity, provably impersonated O!Ciel to his servants to gain admittance. Furthermore, there is no logical way to spin the Funtom music hall as furthering the aims of the cult. There isn't even an opportunity for blood to be collected at Funtom. So pulling away Sphere's guests, exposing it, and getting it shut down just shuts off the blood entirely, for which there would be no apparent gain if O!Ciel truly was the cult leader.
