Yeah you will need to be able to tie it to race, religion, or sex if you want to win, but litigation is expensive and disruptive so even the weakest cases get settlement offers of at least a couple month's pay. You would have to file with the EEOC or state equivalent, you can't sue without doing that.You may have a case though if you can show that other similarly situated employees who did not share your protected class were treated differently from you for reasons that cannot be explained.But the most important thing is don't quit, if you do it becomes much harder to win an employment case, since now you have to prove they made your job so intolerable that you had to leave, which is very hard to do. Do what you can to follow the PIP and see what happens.

u should unironically go on FMLA after 1 month of a PIP. that way u can still apply while technically employed. Then return after taking 1-3 months off (usually unpaid) and they cant fire u for HR legal reasons for like another 45 paid days.
