There was a legal requirement in the event of sale or going public, but like with any private shares they're very restricted in what you can do before the company does either of those things.
The real thing that fucked them was that they issued new classification of share to a hedge fund over the top of them that was legally higher priority. The eventual sale price could only cover those, and there was nothing left over for the chumps.
