The characters and individual publishing wings are owned by the creators. Lee taking Wildstorm with him isn't something you could "see"; it was always a given. His to take. Marvel could only take Maxx or Shadowhawk if they approached to purchase them from their creators. Like how Sam Kieth has published Maxx through IDW, and been able to do a Batman crossover with DC-- but neither company owns the character.
