It ultimately falls on the EIC to notice shit like that before it gets to the printers. When Bachalo agreed to take the assignment he told Marvel that another Death book was going to be coming and he was going to have to take time off to do it and they were cool with it. Eventually Bachalo got frustrated and was like "look, I'm under contract to do Generation X and I need to get back to doing it" and bolted which is why only wound up doing issue 1 and part of issue 2 of that mini.
