Yugi's hax has always been underrated in battle boarding. Penalty Games are always rigged in favor of whomever's holding the item. Unless you have an item of your own, it's not a fair fight. And yes, it's possible for them to skip the game and just kill you. Pegasus did this against Bandit Keith with the eye. The puzzle is even stronger, so if Atem wanted to be a dick he could have killed Ash by doing pic related. Then there's the whol bullshit about YGO monsters being retardedly powerful and the Puzzle's own magic on top of that.
