In 2024 it was true that only SBW, GG and PC were the only public domain Mickey Mouse shorts but we're already at the first 24 Mickey Mouse cartoons being in the public domain here and in five years it'll be up to the first 79.

When it comes to Betty Boop, yeah, for the next 362 days she'll have to be a humanoid pug thing if you want to use her. But next year she'll already get to look like a human being... As much as she ever looked like a human being that is...

Of course, this might not be the case anyway, since several Betty Boop cartoons are both available and in the public domain already, most of which feature the more recognisable design. In fact, according to Wikipedia, 51 Betty Boop cartoons are already in the public domain due to neglect,

So it's probably fine to draw Betty in a more recognisable way, all that changed now is that the original short to feature her is in the public domain which means Paramount can no longer prevent other people from using her.

While a plain reading of copyright law would support the idea that Human Betty Boop should be fair use as cartoons featuring that are public domain, the accepted de facto law that everyone has essentially agreed to abide by (because the very concept that ideas WITHIN a work could contain their own separate copyright wasn't even a thing back in 1930s) is that a element only becomes fair use if the very first instance it was established in is also fair use.

So despite Betty Boop cartoons being public domain for decades, Betty Boop herself wasn't public domain because Dizzy Dishes wasn't public domain.

Likewise, her being human isn't public domain because the first cartoon she was depicted as human is not public domain.

Legally this is very shaky and not really supported by the text of the law, but courts are very resistant to shaking things up, because the problem will resolve itself over the next few decades as all the works needing manual copyright enter public domain.

I really wish those movies had the tiniest modicum of effort put into them. It wouldnt take alot to make a decent horror reimagining of Pooh and friends, let alone the other PD additions like Pinocchio or Bambi. He has been for decades. Quality was more or less another Fawcett situation. They barely scraped by into the early 50's, with Plas and Blackhawk doing all their heavy lifting, only for DC to swoop in and buy them out shortly after. Just like with Fawcett however alot of the early issues werent renewed. So tons of them just lapsed.
