Technically neither. Tom's just trying to do his job as a house cat and Jerry's, understandably, trying not to get fucking killed. It's part of what makes the dynamic work so well, although most people end up sort of rooting for Tom just because he almost never wins and gets the REAL shit end of the stick in some episodes. Neither of them are actually "the bad guy" though.
