That's what happened in the comic. Gilda was the first murderer. The difference between the two is that Batman never found out about it until The Long Halloween Special from a few years ago. In the movie, he does find out, but it's kept ambiguous what happens to her. Maybe he felt sorry for her, maybe not.

Loeb got away with it because no one gives a damn about comics. For the animated movie they realized they absolutely would have a legal problem, which is why they removed all of those "homages." No more "I believe in Gotham city," no Harvey writing down license plate numbers on "the day of my daughter's wedding" No "You start with a little oil, then fry some garlic. Throw in some tomatoes, tomato paste, fry it and make sure it doesn't stick," etc.

The logic behind the changes in this particular film was that the original twist ending was incredibly stupid and requires a lot of willing suspension of disbelief. In the movie they have Batman say he only ever learned how to fight and intimidate criminals and never thought he'd ever have to investigate a crime to explain why it takes an entire year for him to figure it out. Comic Batman would just stare at props in his batcave, say "What does it all mean???" to himself and never do any basic investigative work until it was conveniently too late.

That's a bit of a goal post move from "removed" and "no more", to it's still there but it's not the very first line (it's the last line, right before the intro credits hit). If TLH movie adds Batman fighting Chinese mobsters it's evidently a change to throw the Coppola lawyers off. As we know, all the DC comic adaptations are faithful as hell and never make frivolous changes so it must be to avoid a lawsuit here.

The extent that Loeb did it would make it actionable.
Additionally, the point of a lawsuit isn't to win, it's to get a settlement. WB lifted aspects of a Larry Cohen script for their League of Extraordinary Gentlemen movie. He sued, accused Alan Moore of laundering his ideas for plausibility, and they settled. Moore was pissed.
