Oh no! You mean I will only be be able to depict him a rich dude who lost his parents and now fights crime with gadgets while using a bat themed outfit? That's so unrecognisable from what the character is thought of as, and I really have one whole year more to have him fight the Joker alongside Robin? Oh, how will I deal with it?

Seriously, dude, "that version" of him isn't some unrecognisable prototype like Blade or the Blue Beetle. The only meaningful difference is that he's fine with killing people with a gun, which you are free to ignore. Most other things are likely to be dismissed before ever going to court for being too conceptually generic to copyright. Saying Batman can't be allowed to use a computer because DC didn't show him using one until nineteen-shitty-whatever is retarded and no judge will give a shit.
