I don't think there's any laws preventing her from presenting herself as the character from the show. At most it's just cosplaying but by the actual actress, unless that makes it too closely asociated to the official product.

I think the Spook must have been inspired by Batman's guest appearances in Scooby-Doo. He started as a hirable diversion, like a rebooted Killer Moth you'd call to trick Batman with glowing paint and a mirror and make him forget he was chasing carjackers. Then he came back as a burned CIA glowy spook and a living pun which I appreciate. He didn't really deserve better than dying for Damian's cred but I would have picked someone else, you know?
