I suppose it's not impossible that Smith never actually got permission to kill Mysterio and was just relying on being allowed to do it because of his star power.The Spidey office tried to just power through it and be vague in later stories whether Mysterio was still alive or if it was a new guy, while Byrne had an online feud with Smith over it, but at the time Marvel were really trying to push 'Guardian Devil' as one of their best stories of all time, and drawing deliberate parallels with Kraven's Last Hunt, and then Quesada became EIC, and messing with one of the works that got him there just wasn't happening, Mysterio was effectively radioactive for most of the 2000s because of this mess.

This was ignored by the Quesada era people except for PAD who tried to acknowledge past stuffByrne went on the AOL boards to shit on how Smith and Quesada handled things and how the book was heavily late. Supposedly part of the reason the book was late was because Quesada had to attend a family member's funeral, and Byrne remarked that if Marvel Knights Daredevil had been on time to begin with that wouldn't have affected anything. It's believed this is what prompted Quesada to eventually retaliate when he became EIC and canceling Hidden Years.
