If you're in the EU, you can. It's part of the provisions of the GDPR. You don't even have to prove actual damage due to misuse of the stolen data. They acknowledge damage to mental health as a valid form of damages you can sue over. Simply the distress and sleepless nights over what might happen to you with your data stolen and 'out there' qualifies.

These were cases of Discord's automated age check failing and users being required to manually contest it via their support division; which in turn required those end-users e-mail them a copy of their ID. The exfiltrated data probably was just undeleted e-mails scooped up from a mailbox the malicious actors got access to.

It's very common -- and in many countries highly illegal; but hey - who cares about complying with the law, right? /s -- for corporate email boxes to have compliance scans or scans for appropriate content, protection against private use, etc. that operate on copies. Or to preserve safety copies of everything for paper trailing, indemnity, etc.

Any of a myriad of possible ways such extremely sensitive data could've ended up being stuck somewhere in a recoverable manner, simply because it should never have been requested to be communicated through such completely ass-blastedly stupidly unfit channels.
