James Edward Smith was the 36th person Texas executed since 1976, for murdering an insurance manager in an armed robbery in 1983. While the crime was not especially unusual in of itself, Smith gained some notoriety for his last meal request. Smith, an African-American, was born in Louisville, Kentucky on October 19, 1952. Not much is known about his early life, but his mother claimed he was a normal child until some point in his teenage years when he got into practicing voodoo rituals. Smith claimed he participated in six ritual killings and that he threw the dead body of an infant over a bridge after being beheaded in a voodoo sacrifice. He was living in New Orleans for a time where he worked as a tarot card dealer before moving to Houston where he got a more conventional job as a taxi driver.Smith did not have a criminal record prior to the events of March 7, 1983 when he walked up to a teller's window at Union National Life Insurance Company in Houston with a gun and a ski mask over his face. He slid open the glass window and ordered the teller to hand over the money. She refused and hid behind a file cabinet. Smith then turned to Larry Rohus, 44, the company district manager. Rohus obeyed and went to get money from the cash drawer. He placed it in a plastic bag and handed it over to Smith. Rohus pleaded with Smith to not shoot him and began removing a bracelet on his wrist. Instead, Smith shot him twice, one round going into his chest and puncturing an artery. Rohus succumbed to his injury in a few hours.
Smith fled on foot and was pursued by two other employees at the insurance office. He shot at them outside an apartment complex before stumbling and falling. A group of people tackled him to the ground and a police officer who happened by and noticed took him into custody. The money and gun were found nearby. Smith was charged with first degree murder and armed robbery and held without bail. He tried to flee the courthouse during his arraignment and was caught a few blocks always. Smith was found guilty and sentenced to death April 5, 1984.The state court of appeals upheld his conviction in 1987 and he decided against further appeals. Smith maintained his innocence but decided he had no desire to spend decades on death row and believed there was no chance of getting his conviction overturned. His execution was scheduled for May 11, 1988 and he requested a lump of rhaekunda dirt for his final meal, but the prison refused his request as it was not on the list of approved foods and that he would get a standard prison meal instead. The dirt was believed to be eaten in voodoo rituals and that Smith thought eating it was necessary for reincarnation. A few hours before the execution was to take place, his mother filed an appeal with the Supreme Court on the grounds that he was mentally incompetent. The Court however fell one short of the required four votes needed to halt the execution, prompting Justice William Brennan to decry, "For the first time in recent memory, a man will be executed after the court has decided to hear his claim."Smith's execution by lethal injectipon was carried out June 26, 1990; having been unable to eat a lump of dirt, he had to settle for a final meal of yogurt. He still maintained his innocence and promised that his ghost would haunt the prison for the next 300 years.
