James Hitchcock was the 131st person executed by Florida since 1976. Hitchcock murdered and raped his teenage step-niece in Winter Garden in 1976. He was an Arkansas native born in Manila on April 5, 1956, one of seven siblings. The Hitchcocks lived in poverty and made a living as sharecroppers picking cotton. James lost his father to cancer when he was 6 years old. His mother remarried, but her new husband was violent towards her and James finally tired of him and ran away from home at 13. He did however graduate high school in 1974, the first member of his family to complete a full 12 years of schooling. He was charged with a burglary about a year after graduation, served several months in jail, and was released in early 1976.After getting out of jail, Hitchcock hitchhiked his way to Orlando, Florida where his brother Richard lived with his family. On the evening of July 30, the family all watched TV together after which Hitchcock left the house to hang out with some friends in Winter Garden and drink and smoke marijuana. He came back at 2:30 AM and climbed through the dining room window.
He then went to the bedroom of Cynthia Driggers, his brother's 13 year old step-niece, and raped her. Cynthia protested and said she was going to tell her mother. Hitchcock wouldn't let her leave the room so she started yelling, a result of which he choked her and carried her outside. Cynthia continued to yell, so he choked her some more and beat her until she stopped moving. He shoved the body into some brush, went back home, washed up, and went to bed. Hitchcock was arrested by Orlando police the next day for parole violation, since he was not supposed to leave Arkansas. Cynthia's body was found shortly afterwards and he was arrested on suspicion of murder. Hitchcock readily confessed everything to police.At Hitchcock's trial, he recanted his earlier confession and instead claimed he and Cynthia had consensual sex, that his brother discovered them, became enraged, and started accusing the girl of being a "whore." Richard choked her in a fit of anger, after which Hitchcock managed to separate the two but too late to save Cynthia. The former said he was sorry about that and he'd gotten carried away. Hitchcock said he'd cover up for him. The jury did not buy this version of events and he was found guilty on January 26, 1977 and sentenced to death.
Hitchcock filed his first appeal on February 17, less than a week after he was sentenced, on grounds of procedural errors and insufficient evidence of his guilt. The extremely busy state supreme court didn't get around to hearing the appeal until 1982, when they rejected it and upheld his sentence. A few months later, Hitchcock appealed to the Supreme Court, which refused to hear the case. The next year, he appealed to the 11th Circuit Court of Appeals, which rejected the appeal in only one week. Hitchcock appealed to the state supreme court again within a few hours of the 11th Circuit Court rejecting him, alleging that his 6th, 8th, and 14th Amendment rights were violated since his legal counsel had not been able to present mitigating evidence at his sentencing hearing. The court again rejected his appeal. Undaunted, Hitchcock appealed to the US District Court for the Middle District of Florida. They rejected his appeal four months later.Hitchcock then appealed to the 11th Circuit Court again on October 3, 1983. A year passed before they rejected him a second time, but a re-hearing was granted on January 18, 1985. The court upheld his conviction seven months later. Hitchcock appealed again to the Supreme Court on April 18, 1986. This time the Court ruled that the trial judge had improperly blocked the defense from presenting evidence and overturned his conviction. They remanded the case to the US District Court in Florida, which then remanded it to the trial court. The second trial saw Hitchcock again sentenced to death on February 24, 1988.
He appealed again to the state supreme court within a month on procedural errors. The court took until 1990 to hear his appeal, and they upheld his conviction. The Supreme Court turned Hitchcock down again in 1991, but in June 1992 the Court overturned his and five other prisoners' death sentences on the grounds that the juries had used an improper standard when handing down the sentences. Hitchcock was tried a third time and sentenced to death in March 1993. The state supreme court overturned his sentence three years later when they found that the prosecution had made unverified accusations of him being a pedophile which prejudiced the jury and made them unable to render a fair verdict.Hitchcock was sentenced to death a fourth time on September 11, 1996. He continued appealing again and again, in 1999, in 2000, in 2004 when the state supreme court refused to grant him DNA testing on the grounds that it was very unlikely to have any effect on his sentence, and in 2008. The 11th Circuit Court rejected Hitchcock in 2014 and the state supreme court in 2017. Just prior to that, Florida had abolished non-unanimous jury votes for the death sentence; although the jury in his last trial in 1996 had voted 10-2 to sentence him to death, the court ruled that this didn't apply to him because he exhausted his appeals prior to the Supreme Court's Ring v. Arizona ruling in 2002.
Governor Ron DeSantis signed Hitchcock's death warrant on March 31, 2026 and after last unsuccessful appeals to the state and US Supreme Court, he was executed by lethal injection on April 30 following a last meal of salad, chicken, ice cream, pie, and soda. The execution took place the same day that Texas executed James Broadnax for murdering two music producers in 2008. Hitchcock had turned 70 a few weeks ago and was one of the state's longest-serving death row inmates, his time on death row exceeded only by Tommy Ziegler, Henry Sireci, and Harold Lucas. Cynthia Driggers' cousin Robert Meadows, a judge in St. Lucie County, remarked that he'd often been asked why it could take multiple decades to execute death row inmates and said he didn't really have an answer for it. Drigger's mother said that Hitchcock deserved his fate.

If you get sentenced to death four fucking times just give up dude. Kinda ridiculous that a guy on death row was able to kick the can down the road long enough that he got executed at....a normal death age. I definitely think death row needs to be handled very carefully to ensure an innocent or incorrectly tried prisoner is not executed. But come the fuck on this guy was as guilty as can be of a heinous crime against a child and was able to sideline his execution long enough that he basically still milked a full lifespan out of it, prison sucks and all but he got to live way longer than someone that lost 4 back to back trials should have.
