Bobby Wayne Woods was the 447th person executed by Texas since 1976. Woods raped and murdered his ex-girlfriend's young daughter in the Granbury area in 1997 and also beat and severely injured her son out of revenge for her kicking him out of her house. He was born in Livingston on October 11, 1965. While the details around Woods's early years are relatively vague, he was diagnosed as borderline mentally disabled and IQ tests estimated his IQ at about 70. He was nearly illiterate and only attended school to the 7th grade, having considerable difficulties with reading and writing. Woods held jobs as a roofer and a restaurant cook and had no criminal history prior to the murder.
At some point, Woods became the live-in boyfriend of Schwanna Patterson, who lived in Rolling Hills Shores. The two had an argument on April 25, 1997 that led to Patterson evicting him from her home. On the 30th, Woods came back to the house late at night where her 11 year old daughter Sarah and 9 year old son Cody were asleep in their rooms. He climbed through an open window into the bedroom, struck Sarah to wake her up, and sexually molested her. Her screams awakened Cody, so Woods ordered both to come with him and get in his car in their pajamas with no shoes on. They obeyed and he drove them to a cemetery. Cody noticed a large knife in the back seat of the car.After they reached the cemetery, Woods pulled Cody from the car and asked if their mother was seeing other men. He then slammed the 3rd grader's head into a tree and choked him. Schwanna found the children missing the next morning and called police. After the responding officer noticed that their bedroom window was open, he concluded that they were kidnapped.
Woods meanwhile was noticed by acquaintances to have scratches on his face and right arm and he gave varying accounts of how he got them. One version was that he scratched himself while removing brush for a friend named Ed Blakeney. However, Woods told Blakeney that he was jumped by a couple of muggers and ran into a briar patch to escape. A female acquaintance named Ann Fifer was told that the scratches were shingles. Woods told a police officer that a squirrel scratched him, but later claimed it was a cat.Woods was pulled over two days later while driving on H-144 and agreed to go downtown for questioning. Since he was unable to give straight or consistent answers to police questions, he was informed of his Miranda rights. Woods consented to a search of his car and confessed to burglarizing the Pattersons' home, where he stole a VCR and a Sega Genesis game console. Shortly afterwards, Cody was found by a local man named Hank Courtney while he was riding his horse near the cemetery. Courtney took the battered boy to a nearby house and called 911. Cody was treated at Cooks Children's Hospital in Fort Worth. He had multiple skull fractures to the back of the head and had been beaten across the forehead, causing severe swelling. Cody also had bruises and welts all over his body from the beating injuries and being stung by ants, and he was badly sunburned and dehydrated.
Woods was formally arrested on May 2 and informed that Cody had told police everything. They asked where Sarah was, not knowing if she was alive or dead. Woods replied that she was dead and he'd cut her throat. He showed them to the body.In a written confession, Woods said he molested the girl, took drugs, and after knocking Cody unconscious she started screaming. He drove Sarah in a car towards a bridge on H-144 as she continued to yell that she was going to call police. Woods held a knife to her throat and told her to shut up or else. He claimed that he didn't intentionally cut her throat, but that she spasmed involuntarily and jerked her neck into the knife blade. The girl's body was clothed in an inside-out shirt, sports bra, and shorts with no panties. The injury to her throat was massive, severing the windpipe, carotid artery, and jugular vein, and she could not have lived more than moments afterward before succumbing to blood loss. Autopsy of Sarah found that her genitals had been mutilated with a foreign object.Woods's semen was found on Sarah's bedsheet, her panties on the car's floorboard, and a garbage bag containing the knife with her dried blood on it, as well as a pawn ticket with his name written on it and addresses for items from the Patterson's home. He also had scratches on his face and arms when he was arrested.
He was tried for first degree murder with a deadly weapon, attempted murder, kidnapping, and sexual abuse of a minor younger than 13 in Llano County in May 1998 due to the extensive publicity surrounding the case in Hood County. Woods testified in his own defense and insisted he never told police "I cut [Sarah']s throat" but that he said "Her throat was cut." He admitted to abducting the children from the house, molesting Sarah, and taking them to the cemetery, but said he didn't intentionally injure them. Woods claimed they were playing in the graveyard, Cody jumped on his back, and was accidentally injured when Woods fell into a fence post. Woods claimed his cousin Jody Milton, who had committed suicide a few weeks after the murders, actually killed Sarah. Supposedly, after knocking Cody out, he drove her to Milton's house and left her with him. However, all forensic evidence from the crime scene indicated that Woods was the perpetrator. Cody took the stand as the star witness for the prosecution and retold the entire night of April 30, 1997 in full. He didn't think he was going to survive; he had blurry vision and was too weak to stand up or yell for help.
Sarah's diary was also read at the trial. In February 1997, about two months before the murder, she wrote "Dear Diary. Guess what? Bobby moved out and we are so so so so happy." In another entry she wrote "I don't like Cody and I hate Bobby" and that she had contracted human papilloma virus from Woods, who also carried the bug. A family physician testified for the defense and disagreed that Sarah had contracted HPV from Woods. The defense also argued that Woods had been cooperative and well-behaved since his arrest and incarceration.Woods was found guilty and sentenced to death on May 28. He filed his first appeal 16 months later and was rejected by the state court of criminal appeals in June 2000. The Supreme Court refused to hear the case the following year. A US District Court rejected Woods in February 2002 and after further appeals over the next several years the end came when he was executed by lethal injection on December 3, 2009. Woods ordered a final meal of chicken sandwiches, hamburgers, and chocolate cake but only ate a small amount of it. He maintained his innocence to the end and stuck to his version of events that his cousin killed Sarah.
In an appeal filed in 2004, Woods claimed that the state's case got all facts about the crime completely wrong--that footprints found at the crime scene were too small for his shoe size, that the semen-stained blanket was Schwanna's, not Sarah's, that Jody killed the girl, that he and Schwanna were legally married and not a common-law couple, that he'd lived with her half a year, not a month like the prosecution claimed, and that the police deprived him of sleep for three days, forged a confession, and made him sign in.Cody was 21 when the execution took place. He stood outside the prison but declined to watch it, saying he'd been waiting for this for a long time and that he'd made a full recovery from his injuries, but still had a scar on the back of his head.It was unclear if Schwanna had been home when the abduction took place. Woods claimed she was not, but the prosecution maintained that she was there and did not do anything to help when she heard the children's screams. She was charged with child neglect and endangerment and in September 1998 was sentenced to 23 years in prison. Patterson's sentence was reduced on appeal to eight years in August 2001 and she was paroled in March 2005.
