>>7895658There's actually no legal protection for parody or fair use whatsoever in Japan, unlike in the USA, the copyright laws in Japan are much stricter. Rightsholders in Japan just have a culture of not pursuing action against certain copyright violations, but legally speaking they can end all unauthorized fanworks in Japan at a whim, like what Cygames did with all nsfw Umamusume content.

A part of it likely has to do with how much of the industry got their start in the doujin market (and I'm not just talking adult works). Even those who didn't make their own, likely engaged with it, since doujin festivals are akin to the scale of the comic-cons in America, so these doujins are very much a big part of Japanese nerd culture.So beyond nerds not wanting to damage a part of the industry they themselves probably love, there's also an understanding that there'd be a big backlash for anyone who does go after these works.And all of this is before even discussing the benefits of it; just like how let's plays and game streams aren't technically allowed because they're using copyrighted materials, game companies allow it because it's so beneficial for their sales and publicity. I imagine there's been a few series and franchises who have benefited immensely from fan doujins.Finally, I wouldn't be surprised if western companies were actually pretty lax about it too, it's just that westerners aren't really willing to risk it; if they're making a fan game/comic/whatever, they'll make it free because that was always the intention for a fan work; if they're making a commercial product, why would they risk having their work wasted by the whims of a third party company? Unlike Japan, we don't have a convention where a large amount of people successfully sell such works, proving their profitability, thus encouraging others to do so.... Though, the big western companies I can think of, like Disney and co., would probably very quickly send C&D's, and a lot of western work that WOULD get a doujin tend to be children's properties - I can't imagine CN being happy about someone selling Adventure Time Porn. However, I can imagine the Creators of Homestuck, or Undertale, or HollowKnight, not giving a shit if you made porn (or just fanworks) of their material. So maybe it's more to do with America's big corporate culture in particular that gives this perception.
