They don't "rise up", they just become increasingly marginalized and continue to commit crimes over and over. We have the largest prison population in the world and the recidivism rate for people released from prison is massive because they can't find jobs and just go back to crime. You end up with a huge population of people that are in and out of prison their entire lives wasting taxpayer money. Rehabilitation is more efficient than punishment in the long term, unless you just want to execute everyone for petty crimes but that's not a practical or realistic plan.

Why? Our prisons are full and housing prisoners is expensive. Our government doesn't even have the infrastructure to hold everyone currently convicted of a crime and it's costing them a lot of money to find all sorts of temporary measures for it.
And then when they come out of prison, they often can't find work and that just ends up costing the state more money as they claim benefits and commit more crimes. What's the incentive to create criminals?
