Free market doesn't work in the real world, the only reason you can afford to buy food is because the government heavily subsidises farming. Governments aren't businesses, they are supposed to offer basic services and infrastructure for every citizen (not just those that can afford to pay the market price for it). Many of these services will operate at a loss, so they need to be funded by taxes. And if a certain activity or behaviour is costing one of these services a lot of money, it makes sense to tax/regulate that behaviour out of existence.

It effectively is a sugar tax. This is Domino's Pizza's drinks menu as a random example. If you compare 1.25l bottles, "Classic" Coke costs 32p more than Diet Coke. For 500ml bottles, the difference between Classic and Diet is 13p. Note that other soft drinks like Fanta don't have the same price increase because their sugar content is below the legal threshold. Additionally, the price difference is based on the size of the drink, since that determines how much "taxable sugar" there is to account for. With free refills, this becomes difficult to measure because the amount of liquid (and thus the amount of sugar) being consumed is variable. So it's easier from an accounting perspective to just avoid free refills entirely.
