Been watching some american court cases on youtube.I find it weird how judges insert their personal opinion and thoughts about cases. So if a sentence can be given between 8-25 years it just depends on the judge and not the law.Very odd how much power judges have in USA.

>>215976487Not sure what you're watching. For criminal sentencing judges mostly follow sentencing guidelines especially if the defendants lawyer is competent. Take a charge, check mandatory minimum (if any), add up points on the circumstances of the crime via a chart and that's how many years you get. Judges sometimes go out of their way to give more time in some cases but it's uncommon. Sentencing guidelines are public for every possible crime, you can find them easily

It's a feature of common law, Britain and Canada use the same system as well.

Cases are frequently complex and have many aggravating/mitigating factors, which require human judgement to weight up and evaluate. The sentences they give are in line with sentencing guidelines, which are often quite wide to account for the sheer number of factors that may be involved.I struggle to believe it's much different under civil law.
