I meant acquiring evidence in a manner forbidden by the penal code/code of law (or whatever the euros call it). It doen't have to be immoral. even if the underlying aim is legitimate, beating a confession out of someone through torture, spying & entrapment, unlawful searches, etc set a precedent for next cases to follow.

It isn't circular, and I'm not arguing semantics over what becomes lawful if the hon. judge allows it. if violations produce results that are judicially accepted, said violations become repeatable offenses and erode the entire point of a "due process".
Isn't this one of those liberties americans always talk about?
