It was removed in 1972 because people opposed it. It was removed during peace time already in 1949. But I think if there was a war the military which basically coups the government in such a situation could just decide to bring it back. I think having a death penalty could actually encourage crime, basically it's a form of suicide for desperate people. But if you know there is no death penalty and instead you'll just rot in prison, it discourages such crimes. If you have nothing left to lose, you might welcome death. But you can still lose your freedom.
