People are still punished for it until it is no longer law. They aren’t outdated concepts. The United States military takes these laws very seriously. If you disobey orders during wartime to the end that it influences life and death, you are absolutely liable to get the needle. Supreme Court said premeditated murder is the only crime where a death penalty can constitutionally be carried out, citing the Eight Amendment, so it’s unlikely to see commonly until congress declares war again.

Deserters aren't executed to punish the severity of their offense, they're executed to discourage other soldiers from deserting.

In many cases in war, it is necessary to send a unit into battle that you know is going to suffer heavy losses or even be wiped out, and it is important to the broader outcome of the battle that they continue to resist the enemy as long as possible even if they're doomed. If you punish desertion with anything less than death, most soldiers would just desert in the face of a hopeless situation, and the enemy would overrun their positions to the detriment of the war effort.

Ask yourself if anyone has been held accountable for any military failures in civilized world in the past 30+ years. A general is more likely to get punished for fucking his secretary than losing a battle in the modern day.

He deserves punishment but on the softer side that if he didn't really directly compromise or get anyone killed in his unit. But the harder side is that he was an uncontrollable pain in the arse that compromised his unit's fighting potential by being worse than useless and potentially causing real problems.
At that point his CO should have just had the MP's get rid of him for malingering and got him the fuck out before it became an issue, but he didn't because there was a war going on and a lot else happening. So they might not have had the resources to do that.

In hindsight, no. He's a fuckup for sure but probably not enough to warrant a death penalty and there's a whole cascade of failures that somehow made him end up there instead of in the rear driving a truck, peeling potatoes or basically anything else that didn't involve being shot at

This was about making an example, and this dumbass had been so utterly brazen about it that any consequence short of putting him up against the wall was essentially undermining military justice as a whole.

If he had at any point, just shut the fuck up and accepted the offer of transfer to another regiment, he would have in all likelihood survived the war. Hell, deserting while he was still stateside or agreeing to a transfer and then deserting later would have offered better chances.
