I went to Silencer Shop today to try and go home with a can, but it turns out they don't actually sell cans that you can get at their store - they require transfers to FFLs (unless you're a ChudToober politician ofc). They said the only FFL they know of selling cans with just a 4473 was down the street. I stopped by the FFL and they were in fact selling cans with people walking out with them. However, it only applies to cans the FFL got from Silencer Shop. I didn't see anything I really wanted or didn't already have, so I didn't buy anything. Lot's of people were buying though. I did get some stickers from Silencer Shop though.

Also BTW they're currently approving caliber: MULTI for form 1 silencers, I've had some denied but the majority have been approved. Also you DO NOT have to submit photographs for it, eForms forces you to attach but IPB told me you don't have to, just submit a screenshot saying no pictures are required or something, for 4h only put your full name (or trust name) and city and state, nothing else. You can make silencers under the listed OAL but no longer, so you can put like 12" OAL and its valid for anything up to and including 12".

Which should always be answered with the general model name, not the SKU. Like if I were making an SBS of a Mossberg 500 as a random example of a gun that has a consistent model name across SKUs (which I haven't checked also does this on a Form 1). You'd select Mossberg as the manufacturer and then click the 4 d dropdown box and it'd list off a ton of SKU numbers when the answer that's actually correct is ALWAYS "Mossberg 500" no matter which SKU you purchased assuming the stamp still says "Mossberg 500".

The ruling on the Jensen v. case provides injunctive relief for plaintiffs including FPC members current and future legally prohibiting the defendant the BATFE from enforcing the marking/engraving requirement punitive provisions USC 5842 (b) and 5861 against the plaintiffs.
It should be noted that the Jensen plaintiffs were not granted injunctive relief regarding AOWs... I'm not sure if this is just with respect to the non form 1 registration manufacturing/configuring of AOWs.... or if it also applies to the marking/engraving requirements for AOWs...
GOA members as plaintiffs in the Silencershop Foundation v. case were granted injunctive relief regarding the non-form 1 non registered manufacturing/configuration of AOWs, in addition to SBS, SBR, and suppressors.

You also can't own an unregistered NFA item when the NFA is working as written. The injunction only provided relief on taxing grounds, but if the tax was reinstated and the injunction overturned it would revert back to old NFA rules which would turn any personally made silencers and SBRs into contraband that you're not allowed to posses. A registered silencer transferred via a 4473 doesn't have the same problem because it's registered as a title 2 firearm so it wouldn't revert to contraband, and like you said you can't retroactively tax the transfer which happened legitimately. My concern is really just for personally made SBRs and silencers which are what I'm more interested in.

History has proven specifically for the NFA that if you make things wide spread enough the government will back away from enforcement like when the M1 Carbine debacle happened and they reduced the barrel length from 18" to 16" in rifles instead of trying to get the guns back.

All the judge said is the ATF and Justice dept can't prosecute people for certain types of violations while the tax is $0. The engraving statutes were part of the Jenson complaint that was rolled into the Silencer Shop case. The Jensen plaintiffs got all the injunctions that the Silencer Shop plaintiffs got, but Judge Hendrix issued a separate injunction for the Jensen plaintiffs preventing the Justice dept and ATF from pressing charges against them. The GOA was *not* a plaintiff in the Jensen case, but the Texas State Rifle Association was, so if you want to make an SBR or SBS and avoid the engraving requirements then joining the TSRA is the way to do it, that gets you protection from all the NFA statutes in the case, GOA membership only gets you protection from the silencer-related portions of the statutes.

While I can't find the original Jensen case files online, Judge Hendrix discusses the consolidation of the two cases in his opinion, and he indicates the Jensen case was also based on the $0 tax issue. If the two provisions they were uniquely contesting were based on some other legal question it seems extremely likely he would have addressed those in his opinion. But he doesn't - the only mentions of "serial" in his opinion are descriptions of the two sections of the NFA that they are contesting.

Is what gives you coverage under both joined cases, states don't matter that just applies to state employees, a little extra protection might be provided if you buy the source parts like stocks or base firearms from PSA but it isn't necessary, just something else your lawyer could bring up in court if it ever came to that.
