Why is it that an excessive (all) amount of sovereignty resides in the hands of the judiciary (the Cathedral) in an ostensible democracy?
idk man but thanks for the rare land
>>24974554It doesn't. Read Montesquieu, read the Federalist Papers.
>>24974554It’s FDR’s world, we’re all just living in it. Seriously, ask Grok or whatever where Curtis Yarvin expands on this, and his argument is essentially that FDR rules from the grave. Every President since FDR nonetheless serves as a version of him, hoping to simulate what was in him original. Practically, what this means is being a caretaker of FDR’s reforms (Medicaid/Social Security/Post-War World Order). The legislature essentially has no real purpose, because FDR basically nailed it. The legislature only job is to simply continue increasing the number of people overseen by FDR’s policies, and taper it back when it’s too “excessive”. Naturally, if the government’s job is basically “Be FDR Forever”, basically, the only real thing for government to do is figure our what FDR would do in response to novel situations, like new technologies or unprecedented jurisprudential issues. The judicial system’s job in this zombie FDR land is basically to stop Presidents when they decide to stop channeling the power of FDR, and try to do something genuinely novel. Yarvin goes a lot more in depth with this, but that’s the basic idea.
>>24974554The judiciary has no ability to enforce any of its rulings. It operates on the hope that the executive actually defers it its rulings, but that's all it is, a hope. Executives time and again ignore the courts and theyre rarely able to do anything.
>>24974609Yarvin is a retarded jewish grifter
>>24974617>hobbesian babbleThat argument didn’t work out against the rise of democracy either. Guns aren’t literally held to people’s heads.
>>24974554In the US the Judiciary has assigned itself more power over time
>>24974619Who gives a fuck? If a Jew says 2 + 2 = 4, are you going to say it’s 5 out of spite? The point stands, basically every single President since FDR is just cosplaying as FDR. Eisenhower was General FDR, JFK was sexy FDR, LBJ was asshole FDR, Nixon was creepy FDR, even Reagan was just old, recission FDR. Obama is black FDR, Dubya was hick FDR, and guys like Bush Sr., Ford, Carter, and Biden got canned after a term cause they fucking sucked at being FDR. The Judiciary has basically usurped this monstrous amount of power because it has the ability to say “FDR would not have approved of that” or “FDR would have approved of that.” Other than pet morality issues like abortion, the courts have gained popularity, and thus power, by basically declaring themselves the executor of FDR’s postmortem will.
>>24974621Nonsequitur. It's not Hobbesean to point out the judiciary has little to no actual power. "John Marshall has made his decision, now let him enforce it." It turns out, he couldn't enforce it. Acquiescing to the Supreme Court is an act of goodwill. They have no ability to force the executive or legislative branches to follow their rulings. They have neither the power of purse nor the power of the military. Even judicial review is entirely an act of Goodwill
>>24974716Originally, Judicial Review was not an intended power of the Supreme Court. It's only by a stroke of luck theyre anything more than a rubber stamp committee.
>>24974617>>24974712Exactly.In the end Hobbes chief argument was proved absolutely correct.>>24974726>I don’t understand what’s being alluded to in the thread unless it’s explicitly spelled out for me because I didn’t read the bookWe know. Many such cases!
>>24975094>it's all ineffective except a monarch so I can only be an alpha in maybe 5 countries at present.>if I stop pestering Christians with geometry and become a beta then I get to claim I was socialist before it was cool.Alright Hobbies, you've made a huge first step today. Even Christians are aware that geometry is just geometry. You save that alpha shit for your bitch and you're an enlightened despot undercover now.
>>24975122MedsLeviathan covers the inherent contradictions in separation of powers at length. In the current system, the voice of the people merely makes suggestions to the judiciary which actually rules. Often the judiciary comes up with its own nonsense in opinions that wasn’t even suggested by either party in the case being considered. This is what you would expect in a Hobbesian framework.
>>24975251>the judiciary which actually rules.Every president defies the judiciary and they do nothing to stop it, because they can't.
>>24975290List examples of when a president defied the SC directly in living memory big fella.Where the SC said no, and they just went ahead and did it anyway, I will wait.
>>24974609>Medicaid/Social SecurityI'm on those Also doesn't picrel talk about large government overreach?
>>24974554To deny actual democracy.
