Norris said the district is cooperating with authorities and reviewing the situation. “In this case, Dr. Roberts completed the I-9 employment eligibility verification form and submitted the required documentation,” she said, and district records indicate Roberts affirmed he was a U.S. citizen when hired. The Iowa Department of Education issued Roberts a superintendent's license in 2023 after conducting criminal background checks, the district stated.

Roberts began serving as Des Moines superintendent on July 1, 2023, after a national search that included third-party background checks commissioned by the district’s search firm and “found nothing related to citizenship or immigration matters related to Dr. Roberts.”

She said the district is working with authorities and continues to gather details about the situation.

"Two things can be true. We must support our interim superintendent and staff as they lead 35,000 students and staff on Monday, because our collective role is to educate and support our students and their families," Norris said. "And we must continue to pursue the facts in this case and understand our school community is still processing this very significant issue."

Associate Superintendent Matt Smith has been appointed interim superintendent under the district’s leadership succession plan, the school announced.

Roberts has existing weapon possession charges stemming from February 5, 2020. He entered the United States on a student visa in 1999.

The investigation into how Roberts obtained the handgun is being referred to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Federal law prohibits individuals without legal status in the U.S. from possessing firearms and ammunition

Daniel Chapin with the nonprofit The Uvalde Foundation For Kids, told Newsweek: "We know many in the community are understandably confused, perhaps even frustrated, with the recent arrest of their superintendent. However, we must not allow this incident to send a message that the superintendent's failures and actions were acceptable. Additionally, we must hold school leaders accountable for answers.

This situation is not about race or larger political issues. It is fundamentally about a leader—an educational leader at that—setting an example and serving his community in integrity, as so many dedicated educators and administrators across Iowa do every single day. The focus must remain on the breach of trust and the integrity required of those who oversee our children’s safety and education."

Des Moines Public Schools Board Chair Jackie Norris said at a board meeting: “We all need to cool down the rhetoric. We should promote true discourse and facts not spread misinformation meant to divide us."

ICE Enforcement and Removal Operations St. Paul Field Office Director Sam Olson said in a statement: "This suspect was arrested in possession of a loaded weapon in a vehicle provided by Des Moines Public Schools after fleeing federal law enforcement.”

Right, actually kind of unbelievable, I know the the state of Iowa does a pretty decent background check and will refuse hiring people on the basis of it. I had family that worked for the Polk County assessors as an accountant and they had people fail background checks and not get hired. How does one of the highest paid employees for the state of Iowa not get the same degree of background check is suspicious to me, someone probably dropped the ball whether that be the HR dept for Des Moines Area Schools or the contracted background check company I don't know. Even a basic NICS check which takes five minutes should've given a red flag for the gun charge unless they didn't do it...
