However, the Justice Department might find that it is unable to prosecute Brian Cole Jr. due to the sweeping order of clemency issued by Trump during his first day back in office. While the White House has brushed off questions regarding Cole's actions, it is clear that the members within the Justice Department are nervous.Trump's nearly year-old proclamation commuted the sentences of 14 individuals and granted “a full, complete and unconditional pardon to all other individuals convicted of offenses related to events that occurred at or near the United States Capitol on Jan. 6, 2021.” The statement covers 1,500 individuals, including those who were charged with assaulting or resisting law enforcement officers.
