The opinion from Assistant Attorney General T. Elliot Gaiser, who leads the Office of Legal Counsel, concluded that the Presidential Records Act exceeds Congress' power and "aggrandizes the legislative branch" at the expense of the independence of the executive branch. Gaiser, who clerked for Supreme Court Justice Samuel Alito, wrote that as a result of his determination that the Presidential Records Act is unconstitutional, President Trump does not need to comply with it. "The PRA is not a valid exercise of Congress's Article I authority and unconstitutionally intrudes on the independence and autonomy of the President guaranteed by Article II," he found. "The Act establishes a permanent and burdensome regime of congressional regulation of the Presidency untethered from any valid and identifiable legislative purpose." The Office of Legal Counsel decision on the constitutionality of the records law was made public Thursday and first reported by Axios. The Presidential Records Act was enacted in 1978, four years after President Richard Nixon's resignation. The law established that presidential records belong to the U.S. government, not the president personally, and must be preserved. When a president leaves office, the Presidential Records Act requires material to be turned over to the National Archives, which maintains the documents. >>
Anonymous 04/03/26(Fri)06:37:47 No. 1502983 The measure governs the records of the president, vice president and certain parts of the Executive Office of the President, like the National Security Council, and sets out requirements for the maintenance, access and preservation of information during and after a presidency. Under the law, the White House must preserve material relating to certain political activities and information regarding the president's duties, including emails, text messages and phone records. But it excludes the president's personal records, which are documents of a "purely private or nonpublic character." The Presidential Records Act has no enforcement mechanism, but Mr. Trump repeatedly invoked the law after he was indicted in 2023 on charges stemming from his alleged mishandling of sensitive government records after the end of his first term in January 2021. In a case pursued by then-special counsel Jack Smith, Mr. Trump was accused of keeping classified documents at his South Florida resort, Mar-a-Lago, after repeatedly rebuffing demands from the National Archives that he turn them over. Mr. Trump denied any wrongdoing and claimed that he was allowed to keep all of the material under the records law. The case eventually ended after he won a second term in the White House last November. The Office of Legal Counsel provides the president and federal agencies with advice on legal questions, and its opinions bind the executive branch. But if a court reaches a different interpretation of a legal question, that determination prevails. >>

Anonymous 04/03/26(Fri)11:32:18 No. 1503038 >>1503034 https://oversight.house.gov/blog/key-excerpts-from-tony-bobulinskis-transcribed-interview/ Nothing Tony Bobulinski said has been discredited. Tony Bobulinski is a former Navy officer, energy executive, and brief business partner of Hunter Biden. In 2017, he was brought in as the proposed CEO of a joint venture called SinoHawk Holdings, which aimed to partner with CEFC China Energy (a large Chinese energy conglomerate with ties to the Chinese Communist Party) to pursue infrastructure and energy investments in the U.S. and elsewhere. The deal involved Hunter Biden, Joe Biden's brother James Biden Bobulinski cites a May 13, 2017, email from James Gilliar (one of the associates) outlining a proposed equity split for the CEFC deal. It allocated 20% each to Hunter Biden ("H"), Rob Walker ("RW"), James Gilliar ("JG"), and Bobulinski ("TB"); 20% to James Biden; and "10 held by H for the big guy." Bobulinski claims Hunter arranged a meeting with Joe Biden on the night of May 2, 2017, at the Beverly Hilton hotel in Los Angeles (while Joe was there for the Milken Conference). He says they spoke for 45–60 minutes about the Biden family's business plans with the Chinese, and that Joe was "plainly familiar" with the details at a high level. Bobulinski has said this directly contradicts Joe's public statements that he never discussed Hunter's business dealings In late July 2017, Bobulinski alleges Hunter sent aggressive WhatsApp messages to a CEFC executive (Zang) demanding immediate payment of $10 million that CEFC had committed to the "Biden family." One message referenced Hunter's "Chairman" (interpreted by Bobulinski as Joe Biden) sitting right next to him, using Joe's presence as leverage. Shortly after, CEFC wired $5 million to an entity in which Hunter had a 50% stake. Bobulinski claims this was an interest-free "loan" to the family and that Hunter circumvented SinoHawk's structure to take the money directly. >>

Anonymous 04/04/26(Sat)08:33:55 No. 1503531 >>1503499 Opinions from the Office of Legal Counsel act as legal pretext for the Executive to take actions in case someone wants to legally penalize them later, at least until those actions get challenged in court, which in this case could be after any incriminating records are irrecoverably hidden or destroyed. They can say they were acting on the best advice of their lawyers and therefore weren't intentionally engaging in misconduct if they get hauled before Congress or a judge. And as a general rule the lawyer won't be held accountable for any illegal shit they okayed as long as they aren't caught blatantly saying "we should do crimes which I know are illegal". He didn't write a fucking opinion article. He created a fucking alibi. Do you not remember the fucking torture memo?
