All of these people belong to various factions, and the factions looks out for their members. Opposite factions will also often cover for each other so that when it comes their turn for a scandal they receive the same protection, though it may still come with some concession to smooth things over.

It isn’t really brown envelopes. How it works, at least here, is:1. You are a member of the same lodge, golf club and social clubs as the local magistrates and police officers. It doesn’t really need to go much further than that for most problems2. Anything you may do that is illegal will be first dealt with by them and they can make it go away3. If they can’t make it go away, then you already have a head start. Joe Wagie can’t do this, but you can. You know which judges will be in which courts at what time. You can have the criminal record of the victim and their families checked. You are already rigging the process in your favour4. If it actually gets to a hearing then you are friends with the entire apparatus. The court staff, prosecutor, defence, judge (or bench of magistrates) is known to you5. In the highly unlikely event that all this fails and you somehow are found guilty, you’ve got all these people to put pressure on sentencing and probationThat’s about it. It’s who you are friends with. There are levels to this, clearly. Playing golf with a detective and sticking £50 in the coppers charity doesn’t get you out of £100,000,000 of cocaine being on your boat. But it will get you out of most low level stuff. For high level crimes you need to operate at those levels, but the same principle applies

>>521060489In the US our legal system is so gargantuan and convoluted that you can find case law to support nearly any claim. This allows judges to justify whatever position they are paid to take, pressure gets put on the prosecutor to let it go, and pressure is put on the media to not report on the case. The last part is why high profile cases that garner tons of media attention will have some huge sentence or judgement handed down that then gets quietly reduced on appeal.

The common law issue is the same though, because of our historical ties to england we will even reach back to historical cases from before 1776 to justify decisions made on the bench.
