(1) Commit the crime knowingly
(2) Commit the crime with the knowledge that the penalty for the crime is death

Yes. As long as there's not doubt that they did it. I'd even support the death penalty for adultery. Any crime where the person who did it 100% knew what they were doing and there's no point in trying to claim that they did it on accident, like robbing a store, I think should carry permanent consequences, amputation scarification etc. forced labor for the rest.
