This guy Zachary had a roommate that had a violent history (hit his wife over the head with a wrench) and he was getting violent with the guy's friends in the house. He tried several times to get the police to remove him but they insisted it was a civil matter and he had to get him him evicted (is that true in cases involving violence?). Well the violent roommate apparently attacked the guy's friend in his house and he shot him to protect the friend acting in defense of her. Roommate survived.
Police charge him with attempted 2nd degree murder. They offer him a plea like 100 times and after a year of him refusing the plea he's ready to go to trial because he thinks he was in his rights to use deadly force to defend his friend in his own home. Well they revoked the plea and re-charged him with attempted 1st degree murder.
He went to trial and was found guilty. Now he's sitting in jail waiting to be sentenced. Here's the crazy part. The guy he shot got arrested for I think assaulting someone else and breaking a restraining order so now Zachary is sitting in jail with the guy he shot and his life is basically over.
But wouldn't he have been justified shooting the guy? He clearly is a violent person and he tried several times to get him removed from his house? What should he have done differently? Can he appeal this based on anything?

His first mistake was not taking the police’s advice about evicting him. It’s frustrating and time consuming but he’d have been on stronger legal ground. Even if he’d just taken the first step at the time of the shooting it would’ve cast the victim as a person who’d been legally served notice to leave the premises due to violent behavior. Shooting him “to protect another person” isn’t justified unless there was a credible threat to that person’s life. The accused claims the victim had a history of violence but also admits that history of violence never resulted in death or the person being attacked almost dying. Besides, the whole incident could’ve been staged by the accused (“he, a person I’ve been trying to get rid of, was attacking her so I had to shoot, by coincidence this also solves my problem”). Again, he should’ve evicted him, by the end he would’ve had the satisfaction of seeing law enforcement drag the guy out of the house. Now he’s looking at 8-30 years depending on his criminal history. Best case scenario if he’s squeaky clean is 8 w/time off for good behavior.

If this guy had been a nigger the police would have worshipped him as god and allowed him to form a street gang and terrorize and plunder the entire community. He’s white though so he has to be beaten to death in his own home, LEGALLY! Wow such noble law enforcement. I’m sure God will respect this behavior and it won’t end with his release.

OP’s friend’s only hope for an appeal is finding some kind of procedural error took place. But you know what? Refusing to accept a plea deal that was offered for ONE YEAR means prosecutors probably built an airtight case. They were literally trying to help him by offering him a deal on a LESSER CHARGE. Your friend fucked up.
