Some real hole in the immigration legal system. Clearly intentional. Not sure why. Possible making it a crime to be in the US illegally, would cause ID enforcement, which would be unconstitutional.A caveat, is if you have previously been deported, and are later found in the USA, then they are committing a crime, therefore criminal by legal definition.
