>SCOTUS Case: Trump v. Barbara>Question Presented: Does Clause 1 of the 14th Amendment support Trumps EO 14160 to end birthright citizenship for children of illegals and temporary visa jeets?>Answer: YES.>Does this apply retroactively?: Yes, SCOTUS rulings on constitutional questions are retroactive to the date the amendment or clause was ratified in the US Constitution. In this case that would be July 9th, 1868. >Why are SCOTUS rulings retroactive?: Because SCOTUS does not "make" new law the way legislatures do; they declare or discover what the law (including the Constitution) has always meant. A Supreme Court decision interpreting the Constitution is therefore understood as clarifying or correcting the true meaning that existed all along>B-B-BUT MUH EX POST FACTOEx Post Facto only applies to Legislature as SCOTUS does not "make law" nor do they have the power to amend the US Constitution by themselves.
Options available to shitlibs to overturn this if they were to gain power:>1: Shitlibs could pack the Supreme Court by doubling or tripling it size with justices that would side with a ruling that would overturn Trump v. Barbara.>2: Utilization of Article V powers that requires at least 38 states to amend the US Constitution.Basically shitlibs are shit out of luck because they will never gain power after 100+ million children of illegals and temporary visa jeets are no longer legally allowed to vote and an ICE agent is placed at every voting booth. What is the oppositions counter argument? (See Pic Related)>Yeah... it's heckin' ICK to bring this to the court, Your Honors.>I rest my case. Racists.
>ex post factoHaven't heard or read that expression from quite some time until now.
When will the decision be made?>inb4 2 weeks
>>526345004Rightoids are going to have a meltdown when they get obliterated in November and in 2028 when they find out illegals don’t actually vote, lmao
>>526345753The schedule for oral arguments will be released in 2 or 3 weeks. They are likely to schedule the Oral Argument for April of 2026 and a ruling is expected sometime around late June or early July.
By the way, I am sure that the retroactive effect of their decisions hasn't much of practical (= real) relevance.I mean, you aren't a shithole where retards think the law is a mere combinations of badly crafted legal documents, you are The United States. As you are, any person who POSSIBLY COULD feel damaged on his/her RIGHTS can look forward to any U.S court of law in order to, v.g., declare null and void the retroactiveness.Or am I wrong?
>>526346030Supreme Court is the final say.
>>526345911>when they find out illegals don’t actually voteof course they vote in every county that shitlibs run the polls and don't have to ID the voter.the other thing that invaders are used for is district apportionment for congress. but that's being cut off at the Census level as citizens and non-Citizens will be counted separately.invaders should count as 0/5ths of a person for apportionment
>>526346030No, because their rights would not be hindered in this case as it is not any law that is voiding their citizenship status it is the Constitution itself which is the SUPREME LAW of the land. As for if they could fight it in court? The answer is most likely no as that would be relitigating the same constitutional question and SCOTUS doesn't overturn their own rulings that quickly. Could states make laws protecting illegals from this change? The answer is no because no legislature can create laws that are blatantly Unconstitutional. The only options are to somehow gain power in a landslide victory and pack the court with enough justices to overturn Trump v. Barbara or they could convene a Constitutional Convention by triggering Article V of the US Constitution which states that 38 states are required to convene a convention to amend the US constitution.
>>526346500>most likely no as that would be relitigating the same constitutional questionOh yeah res iudicata.
One of many many reasons that SCOTUS will rule in favor of Trump in Trump v. Barbara

>>526347776I post it every day by the way. It is the most important happening in Americana history, it is bigger than Hart-Celler, it is bigger than the Civil War. It will unironically determine the future of the United States for the next thousand years. Demographics is destiny.

>>526349201It takes at least 4 justices to even bring a case forward, it is much closer than you think. The Originalist argument is incredibly strong in this case and is buttressed not only by the words of the Clause itself but by the words of its authors and SCOTUS precedent sets in Wong Kim Ark and Elk v. Wilkins.
>>526345911>Rightoids are going to have a meltdown when they get obliterated in November and in 2028 when they find out illegals don’t actually vote, lmaothis is the most cope-iest head cannon.minnesota has lost a seat due to the number of illegals deported from there.more are going to get deported and they'll probably lose another seat.regardless, the re-interpretation of the voting rights act by the supreme court is going to green light redistricting to such an extent that libshits are going to lose at least 16 seats.for the same reason, republicans will be able to lose the entire rust belt (a feat which has never happenend before) and they will win the presidency.the apex of libshit political power has passed and it will continue to wane for the foreseeable future.the right isn't going anywhere.you're free to disagree, but you can't pretend you weren't told how things were going to unfold.
